Brazilian ANP Opens Public Consultation on Fungibility of Biomethane Origin Certificates

Brazil's National Agency of Petroleum, Natural Gas and Biofuels (ANP) announced on Wednesday, the 25th, that it has opened a period for market agents to submit contributions to its study on the fungibility of the Biomethane Origin Guarantee Certificate (CGOB). According to the regulator, interested parties can participate by submitting studies that meet the requirements defined in Technical Note No. 82/2026, with a deadline of April 25, 2026. Following the publication of ANP Resolution No. 996/2026, the ANP will conduct a specific study on the fungibility of CGOB in relation to other environmental attribute certificates. The agency's objective is to identify instruments with potential equivalence and to evaluate the applicable technical and legal requirements. "The study should also include control mechanisms aimed at preventing the double counting of environmental attributes, as well as any necessary regulatory adjustments, providing a basis for future regulation on the topic," states the ANP. The execution of this study aligns with Article 20 of Law No. 14,993/2024, which stipulates that the regulation of CGOB must ensure traceability, transparency, credibility, and, where applicable, fungibility with other certificates, provided that the non-occurrence of double counting is guaranteed. The CGOB, or Biomethane Origin Guarantee Certificate, is a traceability instrument related to the volume of biomethane produced and commercialized within the scope of the National Decarbonization Program.
